These Terms of Use ("Terms", "Agreement") govern your use of the Vexar.io platform ("Service", "Platform"), provided by Celena (business registration number 749292), managed by sole proprietor Volodymyr Franko ("we", "us", "our", "Company").

By accepting these Terms, you enter into a legally binding agreement with us. If you do not agree with any part of these Terms, do not use our Service.

2. Service Description

Vexar.io is a cloud platform for creating websites that allows users to:

• Create websites using a visual editor
• Manage online stores
• Host content and media files
• Connect custom domains
• Use built-in analytics
• Receive technical support

3. Right to Use the Service

3.1 User Requirements

To use the Service, you must:

• Be at least 16 years old
• Have the legal capacity to enter into this Agreement
• Provide accurate and complete registration information
• Comply with all applicable laws and regulations

3.2 Restrictions

You CANNOT use the Service if:

• It is prohibited by the laws of your jurisdiction
• Your account was previously blocked for violations
• You represent an organization from the Russian Federation or are a citizen of the Russian Federation

4. Account Registration and Security

4.1 Creating an Account

• You undertake to provide accurate and current information
• One person can have only one account
• You are responsible for maintaining the confidentiality of login data

4.2 Account Security

• Immediately notify us of any suspicious use of your account
• We have the right to block an account if compromise is suspected
• You are responsible for all actions performed under your account

5. Pricing Plans and Payment

5.1 Available Plans

Free:

• Basic builder functionality
• Vexar.io branding on site
• Limited file storage

Starter ($13/month):

• Full functionality
• Vexar.io branding removed
• Increased file storage

Pro ($24/month):

• All Starter features
• Additional features and integrations
• Priority support

5.2 Payment Terms

• Payment is made monthly automatically
• All prices are in US dollars
• First payment is charged immediately upon subscription
• When changing plans, the difference is charged proportionally

5.3 Payment Systems

We accept payment through:

• Stripe (main system)
• PayPal
• Privat24
• Other systems (as they are added)

5.4 Refunds

• Refunds are possible within 14 days of payment
• No refunds for partially used periods
• Technical support may make exceptions in special cases

6. Domains and Hosting

6.1 Vexar.io Subdomains

• Free subdomain of the form yoursite.vexar.io is provided
• Subdomain must comply with naming rules
• We reserve the right to change subdomain in case of violations

6.2 Custom Domains

• You can connect your own domain
• DNS configuration is done through our control panel
• You remain the domain owner

6.3 Domain Registration

• We offer domain registration services through Openprovider
• Domain cost is paid separately
• Domain is registered in your name

7. Content and Intellectual Property

7.1 Your Content

• You retain all rights to uploaded content
• You grant us a license to use content for Service operation
• You guarantee that you own rights to all uploaded content

7.2 Prohibited Content

It is prohibited to post content that:

• Violates copyright or other intellectual property rights
• Contains illegal materials
• Is spam or fraud
• Contains malicious software
• Violates third-party rights
• Contains adult materials (without appropriate warnings)

7.3 Platform Rights

• Vexar.io and all related materials are protected by copyright
• You receive a limited license to use the platform
• It is prohibited to copy, modify or distribute our platform

8. Unacceptable Use

8.1 Prohibited Actions

You cannot:

• Use the Service for illegal purposes
• Violate the rights of other users
• Attempt to gain unauthorized access to systems
• Send spam or malicious materials
• Impersonate other persons or organizations
• Create multiple accounts to bypass restrictions

8.2 Monitoring and Enforcement

• We reserve the right to monitor Service usage
• For violations, we may block accounts without prior notice
• We may remove content that violates these Terms

9. Affiliate Program

9.1 Participation Terms

• Commission is 15% of each payment from referred users
• We reserve the right to change commission rates
• Payments are made monthly upon reaching minimum amount

9.2 Promotion Rules

• Spam and intrusive advertising are prohibited
• Misleading materials cannot be used
• Affiliate relationships must be disclosed

10. Service and Support

10.1 Service Availability

• We strive to provide 99.9% uptime
• Scheduled maintenance is conducted with advance notice
• We do not guarantee continuous service operation

10.2 Technical Support

• Support is provided via email and ticket system
• Response time depends on pricing plan
• Support is provided in Russian and English

11. Privacy

Personal data processing is governed by our Privacy Policy, which is an integral part of these Terms.

12. Limitation of Liability

12.1 Disclaimer of Warranties

• Service is provided "as is"
• We do not guarantee compliance with your requirements
• We do not guarantee error-free or continuous operation

12.2 Damage Limitation

To the maximum extent permitted by law:

• Our liability is limited to the amount paid over the last 12 months
• We are not liable for indirect or incidental damages
• We are not responsible for loss of profit or data

13. Agreement Termination

13.1 Termination by You

• You may stop using the Service at any time
• Account deletion is done through the control panel
• Unused funds are returned proportionally to the number of service days in the paid plan

13.2 Termination by Us

We may terminate Service provision:

• For violation of these Terms
• For non-payment of services for 30 days
• Upon company cessation of operations (with 30 days' notice)

13.3 Consequences of Termination

• Access to account and sites ceases
• Data is preserved for 30 days for possible recovery
• After this, all data is permanently deleted

14. Changes to Terms

• We reserve the right to change these Terms
• We notify of significant changes by publishing the offer in a new version
• Continued use of the Service means agreement to changes
• If you disagree with changes, you may stop using the Service

15. Applicable Law and Dispute Resolution

15.1 Applicable Law

These Terms are governed by Irish law.

15.2 Dispute Resolution

• Parties undertake to first attempt to settle disputes through negotiations
• If peaceful resolution is impossible, disputes are considered in Irish courts
• Each party bears its own legal costs

15.3 Arbitration

By mutual agreement, disputes may be referred to arbitration in accordance with the rules of the Irish Commercial Mediation and Arbitration Centre.

16. Other Terms

16.1 Independence of Provisions

If any provision of these Terms is deemed invalid, the remaining provisions remain in force.

16.2 Entire Agreement

These Terms together with the Privacy Policy constitute the complete agreement between the parties.

16.3 Assignment of Rights

You may not transfer your rights under this Agreement to third parties without our written consent.

16.4 Waiver of Rights

Our failure to exercise any right does not constitute a waiver of it.

• Possibility of forced advertising placement (with advance notice)
